Terms of use

1. General

1.1 WorkEma.com (hereinafter "WorkEma") is a service dedicated to helping workers, businessmen and companies cooperate, establish strong connections and maximize their benefits in the working process. WorkEma is the asset of SoeBusiness OÜ (VAT:EE101812579), and is regulated by these Terms of Use ("Terms of Use").
1.2 Please read these Terms of Use before using the service ("Service") provided by WorkEma. Using the Service, by default, implies agreement ("Agreement") to these Terms of Use, your legal age (as it stands in your country of residence, but not less than 18 years old) and your legal representative status.
1.3 All changes to these Terms of Use are implemented upon updating on this website immediately. You will be notified of such changes via e-mail 3 days prior to implementation. WorkEma recommends you to review these Terms of Use occasionally.
1.4 If you disagree with any section of these Terms of Use do not proceed with the Service.
1.5 In any case of dispute regarding the interpretation of terms in these Terms of Use, WorkEma comply with the official laws of Estonia.

2. Account

2.1 There are 2 types of Account on WorkEma: 1) Business Account 2) Personal Account, they are suitable for different types of Profiles (see p.3); both types of Account imply as "Account" hereinafter.
2.2 Creating an account ("Account") allows you to use the Service in its full capacity and implies the following conditions:
2.3 Third parties can represent job seekers, workforce hirers, Workforce Suppliers only by mutual agreement.
2.4 Registered (on WorkEma) users are responsible for keeping their login and password safe at all times; never share them with anyone. In case of an unauthorized access, you are strongly recommended to contact us immediately (support@workema.com). WorkEma disclaims warranty for such case scenario.
2.5 By default, you agree to receive messages from WorkEma, unless you express objection regarding a specific category or specific categories of messages via online chat or e-mail. WorkEma will only send you business-related messages (no commercial advertising). Please contact us (support@workema.com) if you have any question.
2.6 The account can be terminated by the account owner’s request or as a result of a breach of these Terms of Use. Should you request to delete your account the Agreement will be instantly terminated. The terms in these Terms of Use that require performance after Agreement terminates will survive and continue in full force and effect. All user-generated information will be stored for at least seven (7) working days after the inquiry of account termination unless you request to consider otherwise via e-mail regarding specific information that you have provided. WorkEma may delete any account due to a breach of these Terms of Use immediately. You will be notified of account termination by e-mail.

3. Profile

3.1 You will be asked to create a profile ("Profile") within your Account in order to make ads and interact with other parties. The Service provided by WorkEma is aimed at helping:
Workforce Hirers – to find workforce anywhere in Europe,
Job Seekers – to find employment anywhere in Europe,
Workforce Suppliers – to find workforce posting/ leasing opportunities anywhere in Europe.
3.2 You will be able to choose a suitable category when creating your Profile. An Account may contain one Profile only.
3.3 You consent to provide accurate and relevant information in your Profile. Please update your Profile upon current changes in the information provided previously.
3.4 You will be required to fill in all mandatory fields, which are marked with *; filling in unmarked fields is optional.
3.5 You may not use your Profile to:
A) Harass, stalk or otherwise invade the privacy of others
B) Abuse, threaten or otherwise humiliate the dignity of others
C) Promote, advocate harmful behavior and breach of the law
D) Spam
E) Express profanity, defamation, obscenity, aggression
F) Act on behalf of WorkEma or any other company, agency or individual you do not legally represent
3.5.1 You may not upload:
G) Any material without copyright and/or suitable legal permission
H) Harmful scripts, software, files
I) Software for processing information
3.5.2 Your materials may not contain, promote, advocate:
J) Any forms of xenophobia
K) Violence
L) Political parties, political agenda
M) Religious beliefs, religious propaganda
N) Explicit sexuality, pornography
O) Illegal exploitation of underage (18 y.o.) individuals
P) Any forms of discrimination
Q) Links, references to third parties
R) Links, references to competitors of WorkEma

4. Ad

4.1 You may choose to create an ad ("Ad") within your Account to attract a suitable counterparty. All Ads are moderated by WorkEma.
4.2 You consent to provide accurate and relevant information in your Ad. Please update your Ad upon current changes in the information provided previously.
4.3 You will be required to fill in all mandatory fields, which are marked with *; filling in unmarked fields is optional.
4.4 Your Ads may not contain:
A) Advertising of sexual services, drug traffic, gun trade and any other illegal business-related activity
B) Inaccurate, false, irrelevant, misleading, incoherent information
C) Requirements, conditions and/or descriptions that contradict applicable law
D) Club membership, distributorship, pyramid scheme, sales arrangement, marketing opportunity
E) Up-front payment clause, periodic payment clause
F) An absence of employment opportunity
G) Any names, attributes, credentials, intellectual property of companies, agencies, individuals you do not legally represent
H) More than one employment opportunity in one Ad
I) Links to third parties, links to competitors of WorkEma
4.5 Your Ad will be published automatically; however, WorkEma reserve the right to delete any Ad without further explanation.
4.6 Ads are published for the period of 60 days; you can modify, delete or renew your Ad from your account.

5. Quick Ad

5.1 You may choose to create a quick ad ("Quick Ad") without registering an Account. Quick Ads are not moderated by WorkEma; however, we reserve the right to use contact information for marketing purposes.
5.2 You consent to provide accurate and relevant information in your Quick Ad.
5.3 You will be required to fill in all mandatory fields, which are marked with *; filling in unmarked fields is optional.
5.4 Your Quick Ads may not contain:
A) Advertising of sexual services, drug traffic, gun trade and any other illegal business-related activity
B) Inaccurate, false, irrelevant, misleading, incoherent information
C) Requirements, conditions and/or descriptions that contradict applicable law
D) Club membership, distributorship, pyramid scheme, sales arrangement, marketing opportunity
E) Up-front payment clause, periodic payment clause
F) An absence of employment opportunity
G) Any names, attributes, credentials, intellectual property of companies, agencies, individuals you do not legally represent
H) More than one employment opportunity in one Quick Ad
I) Links to third parties, links to competitors of WorkEma
5.5 Your Quick Ad will be published automatically; however, WorkEma reserves the right to delete any Quick Ad without further explanation.
5.6 Provided contact details will be disclosed to all registered user immediately after Quick Ad publication.
5.7 Quick Ads are published for the period of 60 days, during this period you are unable to modify or remove it manually. In order to delete your Quick Ad please contact WorkEma support team (support@workema.com) directly via the email address provided during the Quick Ad creation.

6. Use of Service

6.1 Intellectual property
All scripts, graphic elements and textual elements of www.workema.com, including database and user-generated content, are owned by WorkEma, the asset of SoeBusiness OÜ. The use of the above-mentioned property beyond the Service and/or contrary to the Agreement is prohibited.
6.2 Use of software
In order to use the Service properly you will need 1) suitable hardware 2) a suitable OS 3) a regularly updated browser and plug-ins 4) current versions of .pdf Readers 5) valid e-mail address. The use of harmful scripts, software, files and any other action that evidently leads to malfunctioning of the Service is prohibited.
6.3 Use of data
You consent to only use the data owned by WorkEma within the Service to interact with other parties. All extracts from- and/or copies of the data owned by WE are prohibited.
6.4 External links
The Service may include links to the websites of third parties. WorkEma does neither endorse nor discourage from the use of external links and disclaims warranty for such use. While on another website you comply with the Terms of Use and the User's Agreement of that website.
6.5 Cookies
Cookies may be used while you are using the Service. You can interrupt the use of cookies by changing the settings of your browser.

7. Liability

7.1 SoeBusiness OÜ liability
SoeBusiness OÜ is responsible for pre-moderation, assisting customers and interaction between parties on behalf of respected parties based on the information provided; drafting contracts, safekeeping of transferred money and implication of stipulated insurance policies.

8. Disclaimer of warranty

8.1 WorkEma disclaims warranty for the accuracy of the information provided by users (no additional research for the sake of validation is performed). You consent to use that information at your own risk.
8.2 WorkEma disclaims warranty for errors, derivations, and consequences caused by- or related to an internet connection, provider's and hosting activity, using external links and unauthorized access.

9. Payments

9.1 The Service provided by WorkEma.com is free of charge by the default for all account types (Personal Accounts/ Business Accounts). WorkEma does not collect any payments from registered users with Personal Accounts (Job Seekers).

9.2 Business Accounts have paid functionality: A) Intermediary services B) Contact details (of the registered Job Seekers and Workforce Suppliers) buying opportunity

9.3 In that cases (see p. 9.2), we use third-party services for payment processing (e.g. payment processors).

9.4 WorkEma uses Stripe to process payments. Stripe's Privacy Policy can be viewed at https://stripe.com/us/privacy

9.5 We will not store or collect your payment card details. That information is provided directly to our third-party payment processors whose use of your personal information is governed by their Privacy Policy. These payment processors adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, Mastercard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of payment information.
